    If the company knew or should have know of the dangers but didn't inform the customer then I don't see how they can avoid some form of liability.
    I wouldn't be upset to see the scumbags sued into bankruptcy.

    Well, moderate means an average non-excessive amount. That's not too hard to define if you look at a large group of regular users/consumers.

    Yes, but the definition is simply not excessive or extreme. What's an extreme amount of burgers (for example)? And once you define a finite number of burgers as extreme, is now one less than the extreme a moderate amount?

    It's a stupid argument, but unfortunately, it's a stupid legal system.

    The ruling states that families and smokers only have to prove addiction and that smoking caused their illness. Just do a quick search for McDonald's + addiction and you get back plenty of hits. Next, link it to obesity, which is an easy step. Then compare how much information on obesity is published by McDonald's. Then you're away.

    Alcohol is even easier.

    So a $4 levy on every cigarette just to cover future payouts let alone all the already dead smokers. The judge was smoking something.

    Just going along with McDonalds
    A back of the envelope calculation is 4 million burgers is 20 lifetimes worth of food. "For every 3-4 million burger eaten, one obesity death occurs," doesn't sound outlandish.

    In fairness, most of the big alcohol awareness campaigns are funded by drinks companies.

    It's interesting to compare that compensation figure ($23bn) for one death with the amount ($213k) the US paid for each person it shot out of the sky in Iran Air Flight 655. Inflation doesn't quite cover it.

    This is the 21st Century, we all know that smoking kills and yet we choose to do it anyway. How could you possibly sue a tobacco company when you or your significant other chooses to smoke?

    It makes my Reason Chip malfunction.. *twitch*
