Accident in car, 3rd party gave incorrect details

    Had a crash a few days ago and sustained a few injuries. I have raised the claim with the insurance and the details the driver gave me unfortunately didn't match what the insurers had on their database and are denying liability and involvement. Now, i have photographic evidence of the car including registration plate and have the police coming around to take a statement.

    The reason for this thread is to get a few ideas on how to proceed and to see if there is anything anyone can suggest that i have missed myself.

    As i currently have no car and have had a few days off due to back and neck pain i would like to try and get this solved as soon as possible.

    Many thanks for any help and or advice given.

    If you got back and neck pain go to a doctor and get examined for whiplash
    As long as you got a pic of the cars and licence plate the police will sort the rest not that is any help when your hurting and car less

    I would think that the other driver is now in worse trouble as could be leaving the seen and fail to produce correct documents ?? but not sure on this

    Not much you can do until the Police do their job.

    I'd agree with what Big_malc said though, go see a Doctor. Also make sure the Doctor knows it was a car accident and the Police are involved, just to make sure all the note keeping is up to scratch as it is likely Police and Insurance will want to have a look at the Doctors findings.

    Get examined for whiplash. I am currently working with a guy who got it from the tiniest fender bender imaginable, but just happened to flick his neck at the wrong angle.

    Knowing will help stop you from turning a minor injury into a major or chronic one.

    Sorry to hear your situation, a pain in every sense.
    I had an accident in 1997 and suffered neck injuries, doctor said it was OK on inspection soon after; but I ended up at the Chiropractor 3 months later.
    She looked at my back (went in for lumbar pain) and she immediately asked "what have you done to your neck?"
    Please see a recommended local chiropractor, who will know what to look for and deal with it.
    I have had (minor) back problems intermittently ever since.
    Good luck with getting it sorted and get some treatment.

    You would be best seeing a doctor as has already been suggested.You may think that after a few days off you'll recover.My daughter thought that but now she has been seeing specialists for nerve damage.
    This is after nearly two years.

    If the incorrect details have been passed onto you I would suspect that the driver had no insurance or wasn't covered on the policy.Either way with luck the police will sort it out.

    Unfortunately this things do take time.Does your insurance cover you for a replacement car while yours is fixed?, if so make use of it.Just read the small print to see what charges may apply to you.
    If the 3rd party's insurance is sorted any claim you make against them can include the loss of earnings,damages to your car and the cost of the hire of a car whilst yours is repaired.

    But like i said unless your lucky it may take longer than you like.Especially as you have mentioned that the accident is being disputed.

    In my experience give all the details to your insurer (they should only need a licence plate to get it moving) and tell them to do their job. IF the car is insured against the license plate in you photo they will be able to trace the owner/registered keeper and find out if it was a different driver stolen plate etc. and get to the bottom of it.

    With regards to not having a car can your insurer not provide on until your is repaired or the claim settled? Are you 3rd party insurance or full comp.? I know sometimes a hire car is an extra.

    With the back and neck pain get to the docs a.s.a.p as it can be more serious than you think sometimes they will suggest going straight to a&e.

    Denial of involvement is a potential crime, get your crime report ref from the police and get your insurer moving on it. Whether or not the 3rd party accepts liability is not an issue for you right now, that's an issue for your insurer's loss recovery. It may affect your NCD depending on the terms of your insurance, but ultimately this is why you go fully comp.

    Go see a physiotherapist asap with regards to your injuries. Who pays the bill is less important than you getting the appropriate treatment sooner rather than later.

    have been to the doctors and have seen a physio who both have confirmed whiplash and other bits.

    Thanks for your suggestions. The Police are coming over tomorrow to take a statement. I have everything written down and took as many notes straight after the incident as possible.

    The biggest thing i remember was how much i shook when trying to take notes and using my phone to take pictures.(which is useless)

    If i want the courtesy car i have to pay for it as we are trying to get their insurance to pay for all costs as he hit the back of me. I guess I will see what happens over the coming weeks.

    Unlucky with the injury mate, but at least with it diagnosed you won't inadvertently make it worse.

    Spoken to the police officer today. He said it looks like a very good case and the photographs i took were the saving grace as they cannot deny the car was involved in the accident. It seems at the moment all i can do is wait for the motions to happen. Just paper shuffling now until someone admits liability or a court date gets set.

    Yay! Waiting!
