I ordered my laptop from Kobalt computers on the 7th of September 2011, and was told it would be ready in 3 to 4 weeks. I specified that I needed it for the 28th of September because of a move to university and they said they could accommodate my need.

It is now the 11th of October, I have no laptop, I am almost 1400 quid out of pocket and I am getting next to no correspondence from Kobalt.

I thought I would give them a bit of time seeing as they appear to have legitimate problems with flooded offices (or so they say) but this is ridiculous. I was going to ask for my money back and just get it from PC Specialist (why I didn't in the first place I dont know).

Any ideas on how to deal with them?

I assume you mean you ordered on the 7th September? and not December 2010??

If you are not happy I would recommend getting a full refund and order from elsewhere. Kobalt as far as I know are decent folks and would'nt mess you around without good reason

Yes Sorry, I dont know how I cocked up the month.

Its mainly the fact that I was told it would be delivered for the 28th of september, then due to delays about a week late,

Then absolutely nothing back from them other than to confirm support tickets have been opened due to my "threatening" emails.

If they would just talk to me, I may not be even considering a getting a refund at the moment, they have not replied to my emails, even the nice ones, and their phone line continues to say "engineers arriving on friday, expect to be up by wednesday" and has been for the past 2 weeks.

Again if they would just talk to be instead of stonewalling me, then I might just forgive them.

I just really need my own computer.

So their phone lines are down currently?

And they don't answer their support tickets.

Thats quite shocking. Did you order it with a credit card?

    Plastic has you covered...

PC Technology Buyers Guide: Consumer Rights

and so does the law, so don't worry too much! Also threatening e-mails will get you nowhere although it may allow you to blow off steam! Scale back the tone and remain calm with a civil tongue and it'll put you in a much better position to deal with this issue.

I paid by debit card (bank) so it appears I can claim chargeback which is good.

I ordered on the 7th, Received No correspondence from the 8th to the 26th, when I was told it would be a week late due to backlogs, then nothing, even after opening 3 new support tickets. Im thinking of claiming chargeback and going for pc specialist and they can get it to me before the end of the week + a spare battery, for just over 100 quid more

Thanks for the Consumer Rights link Blogins

No problem! Also the 'Distance Selling Regulations' and 'Sale of Goods Act 1979' apply to this situation if Kobalt computers fail to deliver the laptop in a timely fashion. It sounds like you have been more than patient thus far.

I would advise you detail your case in a letter and state because of these issues you request a full refund then send it via recorded delivery to Kobalt computers. Give them 7 working days to respond then if there is none, pursue the legal alternatives I outline in that thread. Be sure to keep Kobalt computers appraised of any action you take however so they have every opportunity to respond.

Unfortunately It seems that the halifax account which was used to buy the laptop does not subscribe to chargeback.

    Bollocks!

Have you spoken to your bank?

You are their customer they will have some form of protection I would have thought.

Chargeback is awesome though, had to use it on o2 years ago *smug*

Before I decided on getting a computer I looked at gaming laptops, not taking into account I'd probably never run BF3 on it. I looked at Kobalt Computers, I searched Twitter of all things and I read tweets by a guy who had waited months for a laptop. I know there where issues with SB chips sometime ago. And due to apparent stock issues his laptop took months to arrive.

And for some odd reason at one point his order on his account with Kobalt also went missing. Only to come back sometime later and after several emails and failed phone calls finally got hold of his laptop.

Poor customer service put me off ever ordering with them.

I just checked and Halifax debit cards are of the VISA variety so of course they support Chargeback!

Don't take no for an answer, just do it civilly wsmccusker and less of the 'Bollocks'! :thumb:

hate when things like this occur, its only been a victim of a scam or misrepresentation once and it will never happen again, always check credentials, social media and all that for reviews etc. Better safe than sorry.

Wonder what the reason for collapse was, very niche market i guess and economy must be a possible factor. Hope OP gets there money back.. although i think your bank is the only avenue that may pay off

What makes me angry about this is someone at this company new they were going down the toilet. Maybe not the guys on the desks, but the bosses knew and they still took your money.

They should be hung up by the testicles.

Good luck mate and do not take any crap from Halifax about the charge back.

My mate got scammed on festival tickets. Same as you the bank said they did not support charge back. My friend kept piling on the pressure and eventually they caved and he received all his money back.

There is a history of banks trying to wiggle out of charge back, but do not give up the faith and you will get your money back. Good luck.

When you speak to Halifax stay calm and demand to speak to a manager or supervisor.

If that does not work then make an appointment to see the manager of your local branch (this is what my friend did). When you are face to face with the guy, if you stay reasonable he will find it much harder to fob you off.

After that start sending letters by recorded post requesting they answer within 7 days.

Keep copies of all correspondence and make sure they know that if their answers are unsatisfactory you will take it to the Financial Ombudsman Service.

To the best of my knowledge if they provide cards with the Visa symbol then they must abide by certain terms - for example offering charge back in situations where it is clearly justified.
