Kendra Sunderland Video: Are the consequences fair?

    So here's a burning issue - what do you folks think about this?

    If you don't know about it yet, it's all over the news (typical media hype).

    So she might face a year in jail for this. Lolwut?

    I'm not saying she wasn't foolish for taking the risk, but is the potential penalty a bit much?

    so they arrest a teenage girl for filming herself - yet the bankers who stole billions and continue to do so , get away with it.....

    I've done my research. I think a year in jail for that is a bit OTT and don't think she will get it. Would be different if she got caught by kids or anyone else (A troop of nuns walking through the uni library?) and I guess its lucky she didn't.

    I'm going back to research more..

    Yeah I totally agree that a year in jail seems OTT for being found guilty after the fact, and that she wasn't actually caught doing it. She broke the law, fair and square, so fine her and be done.

    TBH some have suggested that the video was leaked deliberately for that very reason. In this day and age it's nigh impossible to find the truth, even from the horse's own mouth.

    I knew of a person who intended to produce porn that would cause outrage due to the location of the shoot and ride that wave of outrage to success. Never happened, but this person clearly saw the sort of free publicity that could happen by deliberately manufacturing outrage.

    Do you know how many porn videos there are of women masturbating in public places? Trust me, she did nothing new. She just got caught, is all. The judge may frown on the fact that this is a public place of learning. If it was a place that children access, she might be in real trouble. As it stands I predict she'll get fined, she'll pay it and the world moves on.

    Is public indecency really a crime if nobody sees it? (in public, clearly people have seen it now)

    Seems harsh to me. If she did it in front people and caused a scene then fair enough. But you can see she is making sure no one can see what she is doing (yes I watched it purely for research purposes :worried:).

    I think they are just trying to make an example to stop wannabe hot teenage babes becoming p0rn stars.

    She's a cam girl, people pay cam girls to do all kinds of weird and less weird things.

    Some people here keep focusing on the 'year in prison' part of the penalty, but the article itself states:

    So that's if she's convicted, and the penalty is up to one year in prison or a $6,250 fine. Most laws here have varying degrees of penalties that can be levied depending on a multitude of circumstances. She she might fight it in court, and maybe she'll get convicted and since nobody saw her in the act and it's her first offense she ends up with time served, or maybe a couple months (with early release for good behavior). Or maybe she decides to plead guilty, saving everyone time in court and a mountain of paperwork, and as a result the prosecution agrees to charge her with a lesser crime and she only gets community service, or maybe she'll get probation and a small fine.

    Really, it's much ado over mostly nothing. Unless she has something else to offer the world, the ubiquity of naughty material on the Internet means she likely won't be able to parlay this into a big career break. Basically, Nexxo called it:

    I was thinking about it more from a philosophical point of view, which Mister_Tad alluded to:

    Ergo, if a tree falls in the woods and nobody is around to hear it, etc. I'm inclined to agree with this line of thinking, and I'd be hard pushed to say "it's a crime, period." I'm not a fundie. :D

    @Nexxo of course it's not new - that's not what I was suggesting. What I'm saying is that whether or not this was deliberately leaked (indirectly) by Kendra is something that'll be nigh impossible to ascertain. Even if she did want it leaked, she'd never admit to it.

    I also agree that it's much ado over mostly nothing, which is why I'm interested to hear people's opinions. This sort of stuff happens many times every day, so why the hype? (simple answer: because somebody wanted hype).

    Doing some more reading on public indecency, apparently you can get done even if no one sees what your doing, at least i think you can. :confused:

    E.g If you are doing the do in your house by a window that can be seen as public indecency. :blush:

    Can you think of another reason why a porn actress would release a video of her masturbating to the general public than, this is, like, how she makes her living?

    Not that I'm an expert but from what others have said she is a "cam girl" so isn't it possible someone else recorded and uploaded it ?

    So in theory she may not have recorded anything much in the same way someone live streaming an event may not be recording what is being streamed.
