European Court issues new file sharing directives

I would have thought that the ECJ would have been well aware that this is such a variable area between Member States that they would have had to issue at least a recommendation. This ruling effectively sets no precedent, apart from maybe that the ECJ is not going to accept referrals on the matter, which means this area of legislation is going to end up even more complicated.

So the ruling is that it is up to the ISPs then?
Better pick an ISP wisely.

Nope, whether or not the ISP has to hand over personal details for file sharers is down to the country's governments to decide.

at least this is a better outcome than legislating all ISPs in all member-countries must hand over users identity.
