You can declare yourself to be the driver, I hope that you are insured!
3 points and a £60 fine usually, how fast were you going? |

Might be offered a speed awareness course. Not entirely sure how they decide that, think it's usually for small margin over and if you've not been on one before.

If you've not got any points you might get given the option of a speed awareness course, but it depends if the local speed camera partnership run the course and on the amount you were over the limit. Most police forces allow a 10 percent over the limit error plus another two miles per hour before they prosecute.

Coming home from Thame at the weekend the wife drove throught he speed camera there at 40 (in a 30 zone) I was like "Errr....Speed camera?" And her reply was "I didn't think it worked?".
Thankfully she'll get the points as she was driving and I'll only be lumbered paying the fine. Still if she does get it then it may make her a little more aware next time.

It's a guideline rather than a 'rule'/standard, which means you can be done for 41 in a 40 if someone's had a bad day,

Some info for you...
![]() 30MPH Zones. The police and camera's are set to go off at 36mph. So you can drive at 35mph, and won't get done, why? Because the law has tolerance. I.E 10% + 2MPH, this is for driver error, and speedo error. If you get caught speeding in a 30mph between 36-39mph, you will have the offer to go on a course. £80 and no points. Which you can only do once every 3yrs. Do 40mph, and the law states this is unexceptible. So hence why you would get the fixed penalty of 3points and a £60 fine. You can work out what speed you can get away with, by doing the 10% + 2mph in what ever zone you are in. But don't do it for the sake of it... Mobile camera vans. This guy thinks he is above the law, by parking illegally, to catch drivers out. The law states, that you can't park illegally, unless you are on call or its an emergency. This obviously isn't an emergency. So any motorist caught by him, can claim that 2 wrongs don't make a right!

Out of film. They still flash, but don't record. Of course, the more modern cameras are digital with an internet connection to bypass this problem, but there are still film cameras around.

A camera van or Police officer do not have this fixed limit, it's the person operating the detection equipment's judgement. The 10% + 2MPH is only a guideline suggested by ACPO, yes most Police forces will follow this guideline, but it's not law. In theory you could be prosecuted for doing 31mph in a 30mph limit but it's unlikely the CPS would take the case forward.

So how does the law with traffic cams work over there?
Do the cams have to prove *who* was driving the car? Say the owner of DeadP1xels car shows up in court and states that he was at work and he has no idea who was driving his car. He lent it out for a charity fundraiser or something. Would the owner still get points on their license? Curious. |

You're legally obliged to know who is driving your car if you allow other people to drive it. If you don't it's either theft and should be reported as such, or if you are covering up, you get the points, but there is another offence if you get found out for covering up I think - contempt of court maybe? I don't know.

Not all regions of the UK offer the driver awareness course to avoid points. Depending on your area, you may just have to take the penalty.
