    I would think it'd be possible to "have a look" (download) what the torrent contains for "legal proceedings" or something like that?
    I'm not a good source on this as I hate torrents but the few times I've used them I think I could see at least some IPs of people sending me bits in the torrent client; so I figure they'd do the same.
    Ehm, there's also something like torrent trackers, which are used by torrent clients for stuff?

    Someone with more experience of torrenting Linux distros and more legal things can probably explain this a lot better. I open the floor to thee, my brethren who are more inclined to share them distros.

    As I understand it, they target torrents that are known to contain games (don't know how, probably just Googling for the game name along with "torrent" on the end?), connect to the tracker and get a list of seeder IPs from that tracker without actually downloading the content of the torrent.

    I don't think that they're sniffing *any* torrent traffic at random, it would have to be targeted (too much P2P traffic on the interwebs)

    Well the easiest way would be to download the torrent itself and log all ips connecting to your machine and leaching from it.
    There are legal holes in his practice as Smegwarrior pointed out.
    Another way is for companies to hire others to do so for them.
    Yet another would be traffic logging and then requesting logs from ISPs and tracker sites.
    There are "other" ways of tracking individuals travels through the vast world we know as the WWW which would land you in prison faster than you can type "qwerty".

    Unfortunately the web has a knack for louring(sp?) you into a false sense of security while sitting in the safety of your own home.

    yeah but paranoia is half of the fun. waiting for the creaking footsteps on the stairs, the bang bang bang as the door gets kicked in and the davenport lyons storm troopers burst in firing their plasma rifles and your heart starts pounding as you hide the secret rebel plans in the droids before making sure that the droids escape in a escape pod, just before....hmmm ok I need to go take my medication back soon :)

    Just sent my letter to them. Couldn't have picked a better day, eh? A poor girl got 16k fine and here I am, denying all accusations :) Still, I didn't do it, so am gonna stand my ground. And I'll go to court if that's what it takes to get your voice heard. Lets get one thing streight, guys - one of us WILL have to go to court and stand up for ALL THE GOOD in the world against that evil evil empire! )) May the force be with you all! I'll update whenever (hopefully never) I get a reply from DL. I just sent them a simple letter, denying all accusations and asking for more information in order to help them catch the REAL offender. Will see.

    good luck with it all if you're going to stand up for it. Just make sure you've left nothing out and your own track record of net surfing is spotless because it will no doubt crop up. and for the experience, i'd play some Phoenix Wright before hand. Get your OBJECTION! shout ready. :)

    This is some of the finest cheesecake I've had in a while :)

    Did anyone else see the douchebag from Davenport Lyons on the channel 4 news this lunch time? I think Krishnan Guru-Murthy could have given him a bit more of a grilling but the bloke made my blood boil with the dribble he was coming out with. However, he actually admitted that if people out-right denied the claims then they are more than likely to drop the case. Surely that's admitting to only going after more vulnerable people?

    It's bad news for file sharers that's for sure but also the ease that they obtained personal information from ISPs that worries me.

    Great thread, been following when i can, bit vitriolic in towards the end, but great.

    i've no sound advice to give but, nw104hh, any more news? what have you done since your last post? have you managed to get some free legal council?

    anyways hope you get DL off your case and admit they're wrong. good luck. :thumb:

    £16,000 how can that be right..

    im getting a little worried now after my first letter i replied to them, with a letter from my employee saying that i was in work at the time, and i got a letter back saying bascially they dont give a 'F' my ip my responsiblity, and i have 14 days to pay or go court that was over 3 weeks ago..im in a pickle i still think if i havnt done anything wrong why should i pay But £16,000 that would cripple me...
    all i can say is arrrrggggghhhhh

    be brave and go to court, call their methods inefficient and fake and get a good lawyer.

    if you were at work, and you can 100% prove it then that kinda proves that either:
    a) someone else used your connection to do it (brings up the whole my connection my fault? thing)
    b) they got their info wrong
    c) you scheduled it to download, and happened to be at work when it did. (not saying you did just saying they might suggest that)
