Is it just me, or does this story sound a little odd...?
BMW boy, 11, banned from driving

My initial thought was "what's the point?", then I laughed out loud when I read this:
Why? IIRC, points last for 3 years, which means that the boy will have a clean licence by the time he's 14...which is still 3 years before he's allowed to drive!
    Pointless, or what?

Very pointless, he should be banned for a year after he is legally allowed to drive! This boy is extremely dumb, and Winchester is full of mad people tbh.

The legal people obviously have no common sense whatsoever, it would be more beneficial if I took charge!

Hmmm...this is obviously some definition of the word "beneficial" of which I'm not aware. A definition which, in this case, means "detrimental to society" :D

I'm sure I've (like a lot of people here) have more common sense than these people banning an 11 year old for 1 year. :eyebrow:

When he applies for a licence it will come back with the ban and points effective from that date.

Hmmm... after reading this and bringing my psychological insight to bear on the situation, I cannot help but having one nagging question:

"Where are his parents in all this?!?"

OK, here's my suggestion. Put the consequences of unacceptable behaviour with those who are primarily responsible for it. Parents should know what their 11-year old is getting up to. If their 11-year old is endangering lives (which is what effectively he is doing) then they are directly responsible. Don't ban the kid. Don't punish the kid. That's the parents' job. Punish the parents for neglecting their parental duties.

Logical, no? I am somewhat disturbed however, that the justice system does not appear to work that way (although I'm sure that as we speak, Social Services are knocking on the parents' front door --yet again). In trying to punish the child (rather feebly) they are creating two problems:

    1. The justice system colludes with the notion that no-one can be held to account for this 11-year old's actions, except the child itself --and only to a very small extent because the poor dear has learning difficulties. The parents are regarded as helpless figures in this, with no parental control or responsibility.

    2. The punishment does not affect the child in any way. He drove without a licence before --so, he'll drive without a licence again. What negative consequences did he experience as a result of his behaviour? None.

This child is experiencing no effective boundary setting, no sense that actions result in consequences. By the time he is 17, he will be totally out of control and seeing the inside of his local prison (and/or drug addictions services) rather a lot.

I beleive that the point will come in to effect after hes got his provisional and the points will remian on his license for 3 years after he has his full license thus he will be banned for another year after he gains his license and the ban that they have imposed will also remian (I think?)

I remember sitting and waiting for my driving test and one instructor turned to the other and said that one of his pupils wanted to put in for his test but it was pointless as he had 9points on his license and your only aloud 6 points then your banned. Which would mean that he would still have 3 points on his license when he did his test again.

Personally I think he should be banned for 5 years when he hits 16 so he cant drive till hes 21 then he will have to go thru an exteneded test and then also have higher insurance.

They should also start introducing bans that limit you to what BHP and CC size you can have, say 1.2 90BHP if your caught speeding @ 60mph in a 30zone.

    Regards

Yes, but if the lack of a licence hasn't exactly stopped him from driving a car at age 11, what makes you think it will stop him from doing so at age 17?

Fair point, the ban should be longer, but the magistrates courts can't hand out bans that long. Oh and with a ban and points on his licence his insurance would make you cry. The down side to this is that he will then most likely drive without it :wallbash:
