Ok so i bought something off Ebay long story short i have'nt recieved anything done a bank transfer assuming i was doing this person a favour as they needed the money quicker

It was for £30 no big deal

I've been waiting for about a month and a half or so now since i made the transfer over counter to her account

She tells me before i paid that she would'nt be able to send for a week due to work commitments i was ok with that.

She then emails me about 3 days after i paid saying she recieved my payment and would be sending the item as soon as she could and apologized for the delay

    No word from her

After that i email her saying about it she apologizes again and says she would try her best to get it sent

This happens again and a little later maybe 4 days after she tells me she has been ill and had the flu (same week i had the flu) so i was ok with it she obviously was a little less understanding of the fact i had been waiting for 3 weeks

She then emailed me saying she would get it sent out on a thursday feeling confident she had emailed me without any nudging her but nothing still.

    Recently i sent this

    "*****

I'm losing a little faith in my purchase please assure me that you are going to make an effort to send it out

    - ******"

i get back a few days later that not to worry she was sending it out that day and i would get the tracking number later that night.

    Nothing....

around 5 weeks i'm still waiting £30 out of pocket and a little frustrated at whether or not i have been ****ed over for a measly amount of money the money is not the problem it was my fault being so trusting but i keep getting false promises if someone was going to scam me out of money they would atleast make it worth there while right? and even if they just wanted £30 they would stop emailing me.

so this is my last email send to her im losing my patience but im not sure whether im possibly being over the top, and there could be a good reason for delay
I admit 5 weeks is ridiculous but i guess there could be outstanding reason for it.

TO CUT IT SHORT for people not wanting to read

Waited 5 weeks for a parcel sender made fake promises but continued to message me reassuring me it would be sent.

Heres the last message im sending before i rethink it

    "
    *****

I have'nt had a reply so im assuming you have failed to send it again

If you cannot send it within the next few days and give me a tracking number or proof i would like the return of my money please, I have been very patient with you in waiting and putting trust in this purchase and its clear im not likely to get anything for my time.

I've been waiting 5 weeks for the item to be sent and still not success assuming the purchase is legitimate.

If i do not recieve the item or refund of money, i do have the account details the money was sent to and the account holders name and whether i see fit i may take the dispute further.

Its critical i get a response to this email within the next few weeks or i will make my own assumptions
    "

Too forceful??? the taking it further is a not going to happen more of a mindless thread it might spark panic in a young scammer

Perfectly fair, I'd say. The fact that she keeps saying that's she's going to send it, rather than she's sent it and it must be lost, would tell me that you're not going to get it.

As you say, you have her bank account details so you're in a very good position to contact your bank and advise them of fraud. You've waited more than is a reasonable amount of time.

Edit: It may be just £30 to you, but if she's done this to 5 other people that's £150.

You've been scammed, so if you want your money then you're limited to the small claims court.

Which incidentally will cost you £30 to proceed with. (See form EX50).

But if you want to proceed then don't send your email above. You're still saying "Few days" etc. Just demand a refund and set a time limit (Say 24hrs)

You do have a confirmed name and address to go with that bank account don't you?

The next few days maybe? I mean, after making you wait 5 weeks it's not unreasonable that you expect some form of reassurance.

I don't think it's too forceful. Ebay has to be pretty tight about any potentially dodgy sellers or buyers so considering most transactions are sorted within a couple of days I think you'll be well supported if you do have to kick up a stink.

    Thats what im thinking

The item was a usual price not super cheap or anythign which is always warning signs

She does'nt seem to be intune with the understanding of internet purchases when you pay for something or recieved money you send an item as soon as you possibly can.

I think you're being absolutely fair. I'd be annoyed if it had not turned up/not had word of sending within 2 weeks. It is at this point that you'll want to get Ebay/the banks involved. If you haven't yet sent the email, change 'within the next few weeks' to 72 hours, as 'few weeks' is a bit vague and might allow them to extend their farce longer than anticipated. They may well be heading for the 'safe' border of 90 days after the transaction after which Ebay won't give a stuff (although, as you didn't use Paypal, they might not be any help whatsoever).

Also, it's "haven't." The apostrophe denotes a letter/digit (or letters/digits) that you've abbreviated the word by, and so as the "o" is left from "not" the apostrophe belongs between the "n" and the "t."

Edit: Damn, way too long typing this, no replies when I started...

I don't plan to take it much further unless i feel its a risk to someone else

£30 is very little too me and thats why i was not so worried when it turned up it

The reason i set the time is because i assume she works full time i only get emails at night and its usually ever wednesday thursday time the days she claims has time off to do this stuff

If i say 24 hours and just for extreme example its legit and she has just been under pressure with everything i could be just doing something ridiculously uneseccary

You went outside the system by paying the way you did they say they will not help if you do that so the best you can do as far as ebay goes is post it in their feedback you should have paid via paypal you would have been claiming you money back now .

Yeh i know i was rather stupid with that

At the time i was more thinking of doing them a favour she said she would except paypal but would only send after 21 days (when the money comes through as her first money recieved)

As it was only a small sum i gave benefit of the doubt

Im not trying to justify it thought it was a dumb move

"She" might not even be a female, it could all be a ruse so you go easy on her. Would you be so patient if it was a hairy fat guy? I'd have gone all Liam Neeson on her by now...

"I don't know who you are. I don't know what you want. If you're looking for ransom, I can tell you I don't have money... but what I do have are a very particular set of skills. Skills I have acquired over a very long career. Skills that make me a nightmare for people like you. If you send my package now, that will be the end of it - I will not look for you, I will not pursue you... but if you don't, I will look for you, I will find you... and I will kill you.

You win the internets for that! :thumb:

Im tempted to send it though... that would be intresting

No its not because i assume she is a woman the account holders name was a womans name but even so if it was a man having little time to do similiar things during the day i understand the pressure you have when sending something

Sorry, but eBay + Bank Transfer = insane.

Set up a direct debit to a charity with the bank details you have. (Not sound legal advice)

I really hope it works out because it's sad to see someone get bitten for being nice. Maybe you could involve the bank or police but they probably won't bother with £30. All that being said, maybe she is 100% genuine. Who knows what happened on the other end of the line.

Oh well its might fault for being to soft

And if its the case her/his case for being a ****

I will change the email down to 72 hours i think i won't do any thing further till after xmas though even if i feel like it so it might be genuine and i might end up getting a email after that time pleading :D

Even if she got a warning or something from her bank it would be worth it

Im not like in trouble because i potentially have lost £30 i have seen worse in the marketplace being lost because of poor happenings

Scrap 72 hours dude, if she only gets thursday off then tell her she has until tomorrow evening ( nice timing eh? ) to post the package & provide a tracking number, otherwise you will be contacting the bank to report the fraud, along with reporting the fraud to ebay- even though you didn't pay with paypal they can still deal with an obvious fraudster who has just started scamming people on ebay...

That sounds a lot like a particular ebay seller that i dealt with some time back. Preemptive waring of possible delay due to work. Then disappears for a week or so. Claimed to be hospitalised, will send asap. Yada yada, delays etc... Then eventually became a claim that has sent. Only conveniently has forgotten to include the tracking no. Then it's the ebay houdini trick of vanishing accounts. Did i mention that it was a UK account with low feedback? Female account name too.

Yah, hound him/her. In your case, it's easier since you actually have a proper bank account to track/report.
