can't be murder. Manslaughter, maybe. But then, 8 year olds don't have much concept of cause and effect.... If he was drunk, and over here, he's only get a 6 month suspended sentence.
That really isn't fair. He obviously had no ideas about what might happen, he was blatantly just sneaking onto a bus to pretend to be a driver or something. Charging the kid with murder is simply insane.
I agree. Trespassing perhaps, as he did break into the bus, but I think crim neg homicide is a bit much.
It is basically one of those human reactions again: something incredibly tragic happens, and people feel upset and angry, and want to be able to blame something or someone. If it not the boy, then the driver on the bus manufacturer. But nobody wants to accept that powerless feeling that sometimes, stuff just happens.
The one question I really have about all of this is... How did a garbage can block her way? Unless the 12 year old was referring to a dumpster or one of those garbage cans that are bolted to the sidewalk, it could have easily been knocked away or she could have gone around it. I reckon she more then likely froze from the terror and the freight overtook her flight reaction.
Well, if "s*** happens" were an acceptable response once in a while, most of the world's problems would vanish. Ah well.
