IANAL but it is 100% illegal to sell used software in the US. There is a statute known as "Right of first sale" (or something very similar) that allows one that has purchased something to turn around and resell it, be it a book, a pen, a car etc. The issue with software is that YOU DO NOT OWN IT, you are licensed to use it under the terms of the EULA. You have NO right to resell said licensed software, period If there is one thing I miss about the UK is sensible IP laws, and y'all are rapidly catching up to us over here.
