    I've read and appreciated everyone's point of view. But right from the begininning of the story headline, to the end of the reader comments, it's all blown out of proportion and consisting of more drama than a Xmas episode of Eastenders.

    Section 17: Infringement of copyright by copying. Specifically, 17(2): "Copying in relation to a literary, dramatic, musical or artistic work means reproducing the work in any material form. This includes storing the work in any medium by electronic means."

    That makes ripping copies of your legally purchased CDs/DVDs/etc a criminal offence under the Copyright, Designs and Patents Act 1988. It was specifically that clause that the 2014 amendment sought to overcome, by adding Section 28B: Personal copies for private use. The High Court has taken Section 28B away again, so the exemption has gone and ripping copies of your legally purchased CDs/DVDs/etc is once again a criminal offence under the Copyright, Designs and Patents Act 1988, Section 17(2).

    It doesn't. It makes it unlawful. But unless there's an associated offence also set out in the legislation (along with the details of the potential fines/custodial sentence) then it's a civil matter, rather than criminal.

    That's certainly one interpretation of Chapter VI: Offences, but I'd hate to be the test case. Especially thanks to the loose definition of 107(1)(e): "distributes otherwise than in the course of a business to such an extent as to affect prejudicially the owner of the copyright," as I could see lawyers getting rich on the exact nature of "distributes" - like, if I rip a CD to MP3 then upload it to my Google Play Music library, did I distribute it?

    But yes, I can see your argument with regards the difference 'twix "illegal" and "unlawful."

    I think you'd have a hard time trying to convince the police to investigate or the CPS to authorise a charge/prosecution. I see your point about 107(1)(e) but I don't think it's so loose as to enable the prosecution of a private individual who's simply changing the format of their owned media and/or uploading to their own cloud account. If it was I'd imagine we're have seen attempts to prosecute by now.
