Storage Hitachi 1TB Hard Drive returns question

    I'm hoping I've posted this in the right section :) anyway my question is this, I bought a Hitachi DeskStar 1TB Hard Drive SATAII 7200rpm 16MB Cache from ebuyer back on the 14th of July this year and it suddenly died on me 4 days ago as in completely DEAD, no spin ups, no noise from it, as if no power in it etc, and I tested it in more than one PC and it's dead in all of them so ebuyer arranged to pick it up and get it replaced but that same Hard Drive isn't in stock so they said that I could replace it with another Hard Drive which was supposed to be in stock on the 1st of December (which has now slipped to the 15th of December!) that Hard Drive would have been the Samsung HD103SJ Spinpoint F3 1TB Hard Drive SATAII 7200rpm 32MB Cache - OEM which would have cost me £6.98 more than I originally paid for the Hitachi drive back in July which cost me £54.99 and they said the difference could be paid from my debit card associated with my ebuyer account which was fair enough.

    Anyway the Hitachi drive isn't in stock and they said it won't be for the foreseeable future and the only other decent one I wanted as a replacement was the Samsung F3 but that's now not going to be in stock at ebuyer for the next 2 weeks and I need a replacement drive quicker than that and chances are they won't receive them (for the 2nd time) on the 15th of December either, so am I within my rights to ask for a full refund as the only other drive I would consider would be this one Western Digital 1.5TB Hard Drive SATAII 7200rpm 32MB Cache - OEM but I'm not wanting to spend more than an extra £20 than I paid for the Hitachi drive right now as I don't really want a Western Digital drive and I already have 1 Samsung F3 drive and am wanting to configure them in a raid array so I have a back up of everything from this day forth as I lost a lot of data when the 1tb Hitachi drive died! I had a lot backed up on DVD's and Memory sticks etc but not everything.

    Anyway sorry for the lengthy post and I look forward to some responses :)

    Considering your already getting away with a lot.
    ebuyer on the site says they have a 28day return window, then its go deal with Hitachi..

    I'd not rock the boat, hope they don't realize what they are doing and tough out the wait cause it'll probably still be a lot shorter then Hitachi RMA.

    You what? When I bought the hard drive it clearly said (and I verified this before I placed the order!) that it had a 1 year warranty with ebuyer then only after that year was up would it be referred back to Hitachi! So what exactly is it I'm getting away with? Apart from nothing.

    The item is FAULTY, and not my fault and it was less than 5 months old so within the 1 year warranty with ebuyer.

    So I don't see why I should have to wait at all, and ebuyer have already verified via enote that they will be refunding the money instead.

    I didn't know that. I based my advice off only what i could find in the general help section of a web site in a foreign country.

    With that tidbit of info though.. Go for it. you payed for a service you have right to expect it in a timely manor.
