Legal Advice...kodak type thing.

    OK, need some help here guys.
    Saw a good deal on a laptop, and bought 2!1 :p It was £300 instead of bout a grand :D
    But i got an email saying "due to error" and they are not going to send me em. Damn
    Anyway, have i got a leg to stand on? IM thinking i havent, but maybe.......Of course in their contract its says they dont honour pricing errors, and they havent taken the money from my card.
    I really wanted that new laptop................

    I thought that if something was advertised at a certain price, the retailer had to honour it. That may only apply to printed adverts though. I think maybe citezens (sp?) advice bureau may be able to advise.

    I thought the same, but if you read they basically cover their back about anything that could go wrong :(

    Whatever their disclaimer says it can't affect your statutory consumer rights. Give them a call, tell them that you know you are entitled to have the laptops at the price offered, and maybe sort out a deal that you can buy one laptop for £300 in return for you not making a fuss. If they are a large company they would probably rather make a loss on one laptop than have bad publicity.

    I think you would be pushing it if you went too far with that one! under the law of contract, when a person takes goods to the counter etc it is them that is making the offer to buy and the retailer has the right to refuse that offer or accept it! This is the case even when things are priced wrongly or the tag etc even states 'offer'! The technical phrase for this is 'Invitation To Treat' - basically, an invitation to make an offer to buy goods. Therefore, probably not too worthwhile pushing your case.

    The £300 for the laptop is the price they are offering which they decide whether they choose to accpet the offer or not, until the money has not been exchanged it does not complete a contract of agreement.

    unless you got a reciept then you havent got a leg to stand on unfortunately, and an email 'acknowledgement' is not a reciept unfortunately. (however the Kodak email was a reciept of purchase, which is why we all got our cameras :D )

    I think you should give it a go. It pays to be cheeky, and at the end of the day, what are you gonna lose? If you complain, give em a sob story, then there is a slim chance u may get em! If you don't then you get nothing. If you complain and they tell you to stick it, then u still lose nothing! :D

    Hmm, cheers for the advice guys.
    I dunno whether il put it on, thing is they didnt take no money or confirm order, i just got got put in the line for order checking and then got a sorry mail.
    Oh well. :(
