Two longtime 49ers season ticket holders have sued the football organization over the pat-down searches it has implemented before games at Monster Park this season.

The American Civil Liberties Union of Northern California filed the suit Thursday in San Francisco Superior Court on behalf of Dan Sheehan, a season-ticker holder for almost 40 years, and his wife, Kathleen, alleging that the team's policy violates the couple's right to privacy under the state Constitution.

"Something's not right here," said Dan Sheehan, a retired glazier who said he'd owned season tickets since 1967. "You don't get a pat-down for going to a public event. That doesn't happen in my country."

The National Football League, citing post-Sept. 11 terrorism concerns, issued a directive before the start of the season for its 32 teams to conduct mandatory searches of fans before they enter stadiums.

Forty-niners spokesman Aaron Salkin said the league was concerned for the safety of its fans.

Am I the only one noticing a trend here? 9/11 is getting blamed for everything these days. Next thing you know they'll be posting armed military guards outside of your local wall-mart with a "specialist" there doing strip-searches to "ensure your safety".

This truely is an insane, stupid, world.

Luckily, Americans are extremely willing to pass the blame onto people that have oil they're not in control of. Total constitutional violation - I felt safer before 9/11 because I didn't have to work about getting felt up by perverted guards.

Is it really a public event? They don't hand out season tickets for free... It is owned by the city but Monster Cable paid for a contract. I would think the 49ers pay to use the stadium and the NFL must have a deal. To me it seems like they have a right to decide the circumstances in which fans enter their stadium.

The team is a private enterprise, not federal government. Searches performed by the government without due cause is one thing. This is an entirely different situation. I'm sure they could have refused and left the stadium without being violated. A ticket refund would seem reasonable.

ffs, i dont see the problem there tbh.
if someone went into a stadium and blew them selves up killing 40 people, would that guy still feel the same about being searched? i think not, he would probably hop over to the other foot and complain about these searches not being done.

When I used to go to raves, everyone got searched before entering (for different reasons to the above), no one bothered.

This sounds to me like someone looking to cash in.

it's just the stereotypical american blame and sue culture to try and cash in...

    frankly, it's ridiculous.
