If you live close enough to invade others space with your smoke then that ruling seems perfectly reasonable to me
Seems a bit ridiculous to me, why can't people sort this **** out themselves without getting the courts involved? A fair solution though, even if it is practically impossible to police.
I can see why this is done - it seems, as RTT says, unreasonable to pollute someone else's space with your smoke and in a world where no-one is interested in their neighbours it's no surprise that it went this far.
because the guy was a lawyer? he knew he would win. Saying he needed a mask though is just BS, obviously he hasn't been to a bar or casino recently
It's lawyers ElThomsono - their first course of action generally seems to be to go to the highest court possible and sort it out legally. Stupid ruling though. Be nice if his house burned down and she sued him for having created lots of smoke.
she did, she doesn't have a choice if he files a complaint. It's like that judge sueing for millions over a pair of pants at the dry cleaners. He was a lawyer and knew how to work the system.
Yet another clear sign of the sickness within or societies, in this case mine. I suppose that according to those logics and that view (no offence) the next step should be… A: put non smokers and smokers in different living areas B: Put those that barbeque and those that don't in different areas (remember, it creates smoke) C: put those that heat their houses with wood and those that don’t in different areas (using wood creates smoke) D: please feel free to extent this thought by implementing all that might bother you in terms of your fellow human beings. (All are invited) Personally, well, I don't like when my neighbours uses their lawn movers on a Sunday morning, so perhaps your right, more policing, more rules and more regulations is required. After all, my neighbour’s lawn mover endeavours disturbs the Sunday peace... ...They also pollute and create noise pollution. Noise pollution by the way; is one major problem in our modern societies. Perhaps I should sue them Cheers.
I'm sure I've read this exact story before, in some other thread here, and I'd swear that everyone was saying that the suing neighbor was the one in the wrong here. I think smoking is disgusting just like the next non-smoker, but I can tolerate it. That whole thing with the mask is pure dramatic effect.
Crazy, absolutely crazy. So where do we draw the line on this? Not allowed to burn garden waste in your garden? Not allowed BBQs?. Like previously said, sounds like the lawyer is trying to make a name for himself. Shame on the courts for giving in to this madness.
I personally can't stand cigarette/cigar/pipe smoke. Tobacco smoke has a strong distinct odor that makes me sick; BBQ and wood burning smoke doesn't have any such effects on me. Also, since pollutants in tobacco smoke don't rise/dissipate quickly, it's in somewhat similar to dumping toxic chemicals on the neighbor's property. Though I can fully understand/appreciate the reason for that ruling; I do feel it was harsh to take it to court. The guy should have tried talking with his neighbor before taking such drastic measures.
I wonder what would happen if her other neighbour complained? Would she only be allowed to smoke inside under a blanket with the lights switched off?
I agree with the ruling in most ways, but it was a bit pathetic to take her to court and not just ask her to keep to smoking to a minimum while he was out in the garden, or while she was near his garden etc. The mask thing is a tad ott imo. As always, i have several points to add. A: No one HAS to smoke, they choose to. Also the second hand smoke from cigarettes is full of Nicotine, Carbon Monoxide etc... thus, rather toxic. B: Other than not smelling to nice, (the smoke itself at least, i personaly find the smell of the cook food quite pleasent) the smoke from a barbeque isn't paticuly toxic to human beings, also, do you know of anyone that has 40 barbeques a day? C: The majority of houses that use wood burning stoves, which lets face it are rather few and far between, use chimney stack, which in general will place the smoke in the very least a few feet above the house, meaning that its at least 15' up before it even leaves the house.
So could all smokers get away now with a 15' high tube to smoke into? Seriously, this is overkill. It's pathetic when people rig the system in this sort of way (By the way, 15" is 15 inches. 15' is 15 feet)
Lol, i think that would work just i can't see many people walking around with 15' tubes, it would look like a bunch of dodgey looking submarines walkign around (Cheers for pointing that out, was watching telly so wasn't paying attention to what i was typing Edited)
What's the lawyer neighbour going to do if the wind blows the wrong way and blows the smoke to them, again invading their space. Is he going to sue God or Mother Nature?
