    Well seeing as Apple got the Samsung Galaxy tab in Germany, Galaxy phones banned in the Neatherlands, and they are holding up distribution in Australia due to patent disputes, I don't blame Samsung at all for doing the same to Apple.

    So people get angry at Apple using patents against other companies, then are happy when it happens the other way around, other companies using patents against Apple.

    And people say there aren't Apple haters on this forum, really.

    Apple use patents against Samsung (and stop distribution) Samsung are now using patents against Apple. I'd say that's pretty fair tbh! Apple deserve everything they get (in this case) - maybe it'll stop them being utterly stupid and bring the patent bashing to an end.

    Nice to see people have actually done their research...or not!

    Apple's complaints against Samsung seem to be ones that relate to UI and how things are 'done' (transitions etc). Basically things that can be done another way fairly easily, which Samsung have demonstrated in Aus by pulling a handful of features that infringed Apple's patents, which means they can sell the Tab 10.1 again.

    Samsung's complaints against Apple are to do with the very nature of 3G GSM technology and hence integral to how any phone using 3G works. Samsung are refusing to licence them to Apple at a reasonable cost, and then taking them to court. I think Samsung may have bitten their own leg off here, as the courts are likely to simply tell Samsung to actually licence their patents to anybody who will pay a reasonable fee, which Apple will pay.

    The patents Samsung are suing for are needed for 3G wireless operations and apple are claiming that they should be subject to FRAND (fair, reasonable, and non-discriminatory) terms requiring Samsung to license them under reasonable terms. Apple have been trying to negotiate with these Samsung for licencing these patents.

    They CAN'T sell the 10.1 in Aus yet. Apple refuses to accept negotiations and their exact words were "We want to maintain the status quo" i.e. "we like being on top so we're going to use our patents when our products can't have a clear and obvious advantage." The design patents they used in Germany effectively mean no one can release a device that is thin and rectangular. Its ridiculous, and counter suing like this is the only way to prevent Apple running away with a 10" tablet monopoly based on patents that shouldn't exist.

    I know they can't sell it yet, as the injunction is still in place, but Samsung are aiming to have the Tab 10.1 available in Aus by Christmas by removing the "offending" features.

    The German patents regarding look & feel only works in Germany by the way.

    I also completely disagree that litigation over patients is the "only way" to stop Apple's monopoly. Release a decent product that actually competes instead.

    Last time I checked, Apple did not have a patent on "thin" or on "rectangular". But there are many ways in which you can design an absolutely ass-kicking smartphone that is very different from the iPhone, as Microsoft has demonstrated with the Windows Mobile 7 interface. There are different ways to design a tablet, as has been demonstrated by e.g. Asus with Google Android Gingerbread and Amazon with the Kindle Fire.

    Come to think of it, there are a lot of ways to design a really good MP3 player that is different from the iPod, as Microsoft demonstrated with the Zune, and iRiver demonstrates regularly with pretty much everything it produces.

    Apple didn't patent "thin and rectangular", as if they had, they'd be suing everybody (Blackberry PlayBook blah blah blah), the patents were particularly relating to the rounded corners, chrome border, single button at base etc. - all together they make up the "look and feel" of a device.

    As I said above, and Nexxo repeated, the way to beat Apple is to come up with a superior device, market it well and don't engage in retarded patent wars. It's possible to do these things, it's just that nobody has beaten Apple at the whole package yet. I think Amazon's Fire may make real headroad in to the market, simply due to its cost.

    All phones have had rounded corners for 10 years. "Chrome" is pretty common. As is black.

    Volume logically goes on the side, power on the top. If samsung had one button left where else would they put it? ergonomically the only place to go is bottom centre, was hardly a creative thought by apple.

    Admittadly the s2 looks a bit like the iphone,but wen you portray your phone as stylish and advertise it so heavily that people think it looks good, then other manufacturers will go with what the market wants. You can't sure for people copying a fashion.

    No, I didn't say that. I said everything as a whole taken together = look & feel, and that's how courts judge it as well. Samsung went a bit too far with their copying in this case.

    TBH, I'm surprised that Samsung got so cheeky with the design of the Galaxy.

    I know all smartphones are rectangular and have large screens, but it just looks a bit too similar...

    I think Samsung is quite clever since the more products apple sell the more profit Samsung would gain too.

    And for a recent news, German courts at first upheld Apple Inc.'s bid to block the sales of Samsung Electronic Co.'s Galaxy Tab 10.1N tablet. Apple said that the merchandise infringes on its iPad. But after Samsung made a few changes, that ban was changed on Thurs.
