Rant What to do with ebay seller problem?

    Unfortunately an ebay seller is really making me frustrated. I'm still waiting for a blackberry curve 8330, hasn't shipped yet and i paid for it August 19th. I already made a claim on paypal seeing as how it took this long.

    If the seller is a 99.2% 10,000 plus feedback ebayer, but won't respond to ebay messages or emails and my item hasn't shipped yet, what should i do? Do i continue waiting it out with no blackberry, or do i buy from another ebayer and just demand my money back whether or not the blackberry from the first person shows up?

    What do i do if both blackberries show up? What do i do if paypal finds it in my favor (most likely since i'm the buyer) and then the blackberry shows up? Do I tell him that he must paypal the shipping money for me to send it back since she took so long shipping it to me?

    If it hasn't shipped after 10 days, then get your money back from PayPal, post a negative review and try a different seller, 10 days to even post the item is ridiculous

    eBay dispute, withdraw payment, leave a neg. Wait for eBay to find in your favour.

    If the phone shows up, tough titties.

    If it hasnt been posted you have nothing to worry about, report it to ebay, claim refund from paypal, and leave neg feedback. Theres very little the seller can do tbh they cant give you neg feedback so you have nothing to lose.

    If i put things on ebay i ALWAYS post them by 1st class signed for the day after they've been payed for. Anything longer than 3 days imo is unacceptable, if your going to put something on ebay put it on when you know you can post it after its finished!

    To expand upon this a little more, I just disputed a case that I tried to settle with the seller though roughly 7 emails in a very professional neutral manner. The seller refused the terms I negotiated, I disputed it through PayPal and received my money back in 3 days.

    For the negative comment business, here's my other experience - I recently left a seller a Neutral comment because the items shipped wasn't the item described. I emailed the seller and
    asked for the missing parts and he/she replied there was none and all was according to the description even tough I pointed out that No, it was missing one key part. I left the seller a neutral comment that stated exactly this - 'item did not match description, seller communicative though which is a plus'. The seller in return (as they're not allowed to leave negative) left a very negative comment in capitol letters with a positive rating. I felt this was unfair and emailed Ebay, and they blocked the comment immediately and apologized for the actions of the seller. So you just need to be aware of some sneaky behavior.

    Let me expand a little on my situation:

    The reason i know my item hasn't shipped is he printed out a shipping label and gave me a tracking number a day after i won the blackberry. It still says my item hasn't shipped though.

    The seller has been on ebay since I've left all my messages, he replied back to a few people who left bad feedback a day after i sent messages to him. My messages have not been answered. I even got contact with another person who purchased another curve 8330 from the seller and he/she hasn't received their blackberry either.

    It has been 9 days past when the tracking number says my item should have shipped, yet still nothing.

    Definitely put in an official dispute, before the seller removes the money from his account, and you're left stuffed!
