Whiplash claim.

    Not sure if you are pulling my leg and being sarcastic or whether you agree :clap:...but in any case the video in another thread in serious called "why you should never talk to the police" explains my point! And experience!

    No, I was agreeing. It's sad that it has got to a) who cries first (playground rules) and b) sort it out yourself or you'll both get arrested.

    Thats incorrect.

    I got rear ended at a round-a-bout by a driver who then drove off. We got the number plate and reported the incident to the police who traced the driver and an insurance claim was put in. A couple of hours after the accident i started to get a stiff neck, nothing particularly painful but it was noticeable. The insurance company asked my gf when she was putting in the claim is there had been injuries, she said no, they asked if either of us had any stiffness in our necks and she informed them that i did and they immediately asked to talk to me. They asked various questions about my neck and i assured them it was fine, just a little bit stiff. They insisted i went to the doctor so i did and explained to the doctor what had happened, that apart from a little stiffness everything was fine and i was only here because the insurance company insisted. I got a lecture about insurance fraud from the doctor despite the fact i clearly stated i did not want to be examined and was there under instruction.

    Anyways the insurance company persued the 'whiplash' claim and despite the fact i provided no medical evidence and had no time off work and nothing worse than a stiff neck for a couple of days i was awarded £1000 compensation. The insurer wanted me to reject that and go for more but i told them no. So the insurer must make money from these claims so its not always fair to blame the person you hit.

    You laughed when your friend got a caution for an assault charge?

    I take it he doesn't fancy working in the majority of the public sector, or anywhere else that requires an enhanced CRB check? I hope he thinks it was worth it.

    No, I laughed when he told me ALL he got was a caution and they got prosecuted for insurance fraud, in his words.

    And no, I don't think he's bothered about working in the public sector tbh and knowing him he probably does think it was worth it.

    Thats the thing guys. I met this lady and I asked her what her symptoms were. She said she couldnt describe them. I asked if she felt her muscles were stiff and she said, no!

    Instead she feels that she is so bad that her neck can't support her head. Ok then, well my head didnt even move and my side of the collision was head on and hers was from the side. Her car didnt even move!
    My insurance company are quite suspicious!

    I'm sorry, but if you have whiplash, you KNOW what your symptoms are. A bloody painful neck! One that's impossible to hide, and one that makes you cry in agony when you turn too quick! Like I said, I had a bad time parking at about 3mph, and I got a sore neck for a few hours, but that was head-on!

    If I were you, I'd get one of your mates to go round hers posing as a double-glazing salesman, and see if she answers the door going "Oh, hello, please co... ARGH! ME NECK! YA BAS....!". Purely for your confirmation, although insurance companies might be inclined to launch a full investigation if they had video evidence. Just saying...

    i was in an accident recently and hurt my neck and back. i had to hire an engineer to investigate and he said when you have an accident you should put in a claim for personal injury straight away even if your not hurt and drop it afterwards if your not hurt.

    i cant remember exactly why he said it. i think it was so you could take the insurance company to court later on whenever you wanted without having to wait for them to make up their mind on whether they want to pay out or not. as a personal injury and a claim against an insurance company are two different things. wish i remembered what he said now. but it sounds like shes looking for the money

    are you paying to fix her car yourself or letting the insurance cover it? if your insurance company is paying for it it doesnt matter how much she will get as loosing your no claims is loosing your no claims no matter how big or small the claim.

    insurance companies are putting alot more effort into investigating claims recently so i wouldnt worry too much they prob wont pay much heed to her

    the cameras in the petrol station mightnt be much use as they probably do that thing with multiple cameras on one tape and the fps are really low and speed mightnt be determinable from them
