Aria told me that they are regularly audited by Nvidia to ensure that they are distributing codes correctly. I suspect if you've just placed an order they could fudge it, but I ordered mine over 6 weeks ago sadly.
I used Live chat. Think the guy had a lot of calls going as it took ages for him to start chatting and ages to respond with very short responses.
Looking at the comments to the article on Geforce.com it appears to be entirely at the retailers discretion, with NVidia telling people who contact them that they need to speak to the retailer they bought the card from. Newegg appear to be providing codes to people who ordered throughout October and I can't imagine they're any less 'audited' than Aria. Ahh, have sent them an email so will see what response I get. Altho if it's not positive I think I may just return the card and buy a new one with the games.
Pretty dumb of Scan tbh, assuming it's the same price you could DSR and reorder if it's under a week and then they'd have to give you the code and you'd be better off. Heck if you were planning on getting those game regardless even if the card is now more expensive you'd be better off doing it.
Ive just fired an email off to Overclockers with the same request - I bought my MSI 970 on the 28th Oct! Hopefully they honour it - still I guess I can return the card and repurchase but are they really going to waste everyones time?
Returning under DSR will be such a ball ache and cost the retailer alot of money, hopefully they will wise up.
I contacted Nvidia first and it was them who advised me to contact Ebuyer to request the code. They can't be all that concerned about giving out extras.

Received a positive response from Overclockers - said they would go back as far as the 27th October. Already had email from them with Steam code - Far Cry 4 for me too!
Overclockers sent an email saying I needed to go to steampowered.com to active it the code.... I actually had to go to Nvidia to Activate it and then to Ubisoft... OC clearly made a mistake but I wont hold it against them!
Ebuyer told me I couldn't activate the code until 31st Jan 2015, that was obviously wrong too. There seems to be a lot of confusion about the offer at the moment.
I got this as well. That's the date the offer ends, so I guess someone at ebuyer has misread the details.
I gave them a call back to let them know they're giving out the wrong date so hopefully it'll be sorted out.
Thanks for sending that transcript though Woody, unfortunately I think a purchase 6-7 weeks ago is a bridge too far for anyone to honour.
