News Gearbox dodges Aliens: Colonial Marines lawsuit

What will fondly be known as the Gearbox Shuffle henceforth.

 

I guess expecting pre-release footage from two years prior to be representative of the final released product and calling that misrepresentation (in the legal sense) is kinda reaching, for the standards of a class action suit. Of course, if they do manage to win, anyone who bought the product can basically stroll up to Sega with a copy of the result and say "pay up, because *this* punk!".

 

To counter, pre-release footage claiming to show gameplay carries the assumption (or implication) that the finished product should at least roughly match or be better than the footage shown two years before release.

An entirely pre-rendered sequence that completely overmatches the finished product is neither representative nor was it ever 'gameplay' footage. If this ever does rumble into court I can see some red faces as the trailer gets played out while a narrator explains every detail that wasn't in the game Jim Sterling style.
