The API call works correctly int he constraints it was meant to be used - that is official USB poll rate. The fact that it was quick enough before the changes to the multi-DPI mechanism for even 1000Hz poll rate, but now it is not good enough for anything above 180Hz is not a bug. It is at best a regression compared to previous state, but it still handles the official definition at official poll rate. In other words, before the change it did the calculation quicker than 1ms. Now it takes it >5ms to do the calculation. It is fine for 125Hz (the official USB poll rate), but not good for anything above that. The method was always DPI aware (unless you added a special call in your code to turn that off) and it is acting correctly for the use it was meant for.

One thing i did notice, Kaspersky Internet Security 2014 was playing up, so if you have it for now you will need the US version which is now working. as soon as a iso is available im doing a fresh install, generally most things are working but some of the drivers for my external devices are playing up
Update: It's been pointed out in the comments that the 32-bit version of Windows 8.1 could still work, although it's been shown that most PCs running Windows 8.1 are using the 64-bit version.
Ah, that makes sense. I'm still running a 32-bit version (when I built my rig, 64-bit drivers were still a bit of a nightmare).
My right click context menu from my network connections charm bar seems to have disappeared in 8.1. Do not approve.
Which version of 3DS Max? Mine's working without issue... and barring a complete reinstall I don't think so...
Graphics drivers up to date? every time i've had max spazz out [though i've never had what you describe though] it's been because it's taken exception to my GPU. Plus on both PCs I updated to 8.1 I had to reinstall the graphics drivers [1 was AMD, 1 was nVidia]
Not sure if this will interest everyone but i have seen some people say they miss Aero glass when using 8/8.1. http://glass8.berlios.de/ Be warned though its still in beta.
